Caldwell Hathcoat, LLC

Richard Hathcoat’s practice and research are focused on insurer funded defense, first-party insurance litigation and claim investigation, natural resources law, title examination for natural resources producers, administrative proceedings including Colorado Oil and Gas Conservation Commission (COGCC) matters. As a former prosecutor, his practice also includes criminal law and DUI defense.

Rich studied at the University of Tulsa, obtaining his undergraduate degree in 1988, and Juris Doctorate in 1991. After law school, he served as an Assistant District Attorney in the Tulsa, Oklahoma District Attorney's office.

His practice then turned to the representation of insurers in first-party claims investigation and defense of "bad faith" cases. He has regularly conducted examinations under oath and taken sworn statements of insureds for some of the largest and most sophisticated national insurers, as well as having defended numerous insureds at trial.

Rich has a published decision concerning the enforcement of replacement cost provisions in a homeowner’s insurance policy, Truesdell v. State Farm Fire and Cas. Co., 960 F. Supp. 1511 (N.D. Okla. 1997). He has instructed continuing education seminars for insurance adjusters and lawyers, sponsored by the Oklahoma Insurance Defense Counsel, and has presented various programs for national personal and commercial insurers.

He is licensed in Colorado and Oklahoma state and federal courts.
