Background and Experience
If you are arrested for Driving While Intoxicated, you face not only criminal prosecution, but suspension of your driving privileges. Providing a breath or blood specimen of .08 or higher may result in a suspension of your driver’s license. However, you are entitled to a hearing to challenge the suspension if a proper request is made within 15 days of arrest. A failure to make a timely request results in an automatic suspension of your license for at least 90 days. Once a hearing is requested, an experienced and knowledgable attorney is critical to challenging the suspension. Should your license be suspended, you will not be able to drive legally without an occupational driver's license. Once again, in most cases, a qualified lawyer is essential to maintaining your freedom to drive when and as necessary.
